INTRODUCTION

Medico-Legal Case (MLC) Policy

Sri Lakshmi Multi Speciality Hospital is committed to providing timely emergency medical care while ensuring compliance with all applicable medico-legal obligations under Indian law. Every suspected or confirmed Medico-Legal Case (MLC) shall be managed with due regard to patient safety, professional ethics, legal requirements and accurate documentation.

This Policy has been developed with reference to the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the Bharatiya Nyaya Sanhita, 2023 (BNS), the Bharatiya Sakshya Adhiniyam, 2023, the National Medical Commission (Registered Medical Practitioner – Professional Conduct) Regulations, 2023, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019, the Clinical Establishments (Registration and Regulation) Act, 2010 (where applicable), the Tamil Nadu Clinical Establishments (Regulation) Act, 1997 (where applicable), the Motor Vehicles Act, 1988 (where applicable), and recognised standards of the National Accreditation Board for Hospitals & Healthcare Providers (NABH).

The Hospital shall ensure that emergency treatment, medico-legal documentation, reporting to competent authorities and preservation of evidence are carried out in accordance with applicable legal requirements while safeguarding the dignity and rights of every patient.

PURPOSE

Purpose of this Policy

The purpose of this Policy is to establish a uniform framework for the identification, treatment, documentation, reporting and management of Medico-Legal Cases (MLCs) presenting to Sri Lakshmi Multi Speciality Hospital.

This Policy aims to ensure patient safety, legal compliance, preservation of evidence, proper coordination with law enforcement authorities and protection of the rights of patients, healthcare professionals and the Hospital.

Emergency Care

Immediate assessment, stabilisation and treatment without unlawful delay.

Documentation

Accurate and complete medico-legal records.

Legal Compliance

Compliance with Indian laws and statutory reporting obligations.

Evidence Protection

Preservation of medico-legal evidence and chain of custody.

SCOPE

Scope of this Policy

This Policy applies to all registered medical practitioners, consultants, emergency physicians, surgeons, nurses, laboratory personnel, radiology staff, pharmacists, Medical Records Department personnel, administrative employees, security personnel and all other Hospital staff involved in the care or management of Medico-Legal Cases.

The Policy applies to all suspected or confirmed Medico-Legal Cases presenting to the Hospital, regardless of whether the patient arrives through the Emergency Department, Outpatient Department or by referral from another healthcare facility.

"Every suspected Medico-Legal Case shall be managed with fairness, professionalism, confidentiality and strict adherence to applicable Indian laws."

DEFINITION OF MEDICO-LEGAL CASE

What Constitutes a Medico-Legal Case (MLC)?

A Medico-Legal Case (MLC) is any case where, after examination by a registered medical practitioner, the circumstances of the illness, injury or death indicate that investigation by law enforcement or another competent authority may be required under applicable Indian law.

Identification of an MLC shall be based on clinical findings, the patient's history, the circumstances of the incident and applicable legal requirements. Whenever uncertainty exists, the attending doctor shall exercise professional judgment and follow the Hospital's MLC procedures.

Examples of Medico-Legal Cases

  • Road traffic accidents.
  • Assault and physical violence.
  • Firearm and stab injuries.
  • Poisoning or suspected poisoning.
  • Burn injuries.
  • Industrial and occupational accidents.
  • Suspected suicide attempts.
  • Domestic violence cases.
  • Sexual assault cases (managed in accordance with applicable laws and protocols).
  • Unknown or unconscious patients.
  • Deaths requiring medico-legal investigation.
  • Any other case requiring mandatory reporting under applicable law.

Fundamental Principle

Emergency medical examination, stabilisation and life-saving treatment shall never be delayed because a patient is or may become a Medico-Legal Case. Medical care shall always take priority, followed by completion of medico-legal formalities in accordance with applicable law.

IDENTIFICATION OF MEDICO-LEGAL CASES

Identification of Medico-Legal Cases

Every patient presenting with injuries, poisoning, suspicious illness or any circumstance indicating possible legal investigation shall be carefully assessed by the attending Registered Medical Practitioner (RMP). Where the facts or clinical findings indicate that the case may have legal implications, it shall be registered as a Medico-Legal Case (MLC) without unnecessary delay.

In cases of doubt, the attending doctor shall exercise professional judgment and, where appropriate, consult the Medical Superintendent or designated Hospital authority. When uncertainty remains, the case should ordinarily be treated as an MLC until clarified.

Indicators of an MLC

  • Road traffic accidents.
  • Physical assault or suspected violence.
  • Firearm, stab or weapon-related injuries.
  • Poisoning or suspected poisoning.
  • Burn injuries with suspicious circumstances.
  • Industrial or occupational accidents.
  • Sexual assault cases.
  • Attempted suicide or self-inflicted injuries.
  • Unknown, unconscious or unidentified patients.
  • Deaths requiring police investigation.
  • Any case where reporting is required under applicable law.

EMERGENCY TREATMENT

Emergency Treatment of MLC Patients

Every patient requiring emergency medical care shall receive immediate examination, stabilisation and necessary treatment irrespective of whether the case is classified as a Medico-Legal Case. Emergency treatment shall not be refused or delayed on the ground that police formalities or medico-legal documentation have not yet been completed.

Once the patient's condition has been stabilised, the Hospital shall complete all required medico-legal documentation and notify the appropriate authorities in accordance with applicable law and Hospital procedures.

DOCUMENTATION

Medico-Legal Documentation Requirements

Accurate, complete and contemporaneous documentation is essential in every Medico-Legal Case. All observations shall be recorded objectively without alteration, speculation or personal opinion. Entries shall be dated, timed and authenticated by the attending Registered Medical Practitioner.

Documentation Shall Include

  • Date and exact time of patient arrival.
  • Patient identification details.
  • History as narrated by the patient or accompanying person.
  • Clinical examination findings.
  • Description, size and location of injuries.
  • Body diagrams or injury sketches where appropriate.
  • Diagnostic investigations performed.
  • Treatment provided.
  • Name and signature of the examining doctor.
  • Time and method of police intimation.

Corrections to medico-legal records shall be made in accordance with Hospital documentation procedures. Erasures, overwriting or unauthorised alterations are strictly prohibited.

POLICE NOTIFICATION

Police Notification & Reporting

Where required under applicable law, the Hospital shall notify the jurisdictional police or other competent authority regarding Medico-Legal Cases. Notification shall be made as soon as reasonably practicable after the patient has been stabilised, unless immediate reporting is required by law.

The Hospital shall maintain a record of all notifications, including the date, time, name of the police station or authority informed, the name of the receiving officer (if available) and the identity of the Hospital employee who made the notification.

Reporting Principles

  • Notify the appropriate police authority where legally required.
  • Maintain an MLC Register and Police Intimation Register.
  • Document the date, time and mode of notification.
  • Cooperate with investigating authorities in accordance with law.
  • Protect patient confidentiality while fulfilling legal obligations.
  • Retain copies of medico-legal reports as Hospital records.

Timely reporting, accurate documentation and professional cooperation with lawful authorities strengthen patient protection, judicial processes and institutional accountability while ensuring compliance with applicable Indian law.

PRESERVATION OF EVIDENCE

Preservation of Medico-Legal Evidence

In every Medico-Legal Case, the Hospital shall take reasonable measures to preserve physical, biological and documentary evidence that may assist lawful investigation or judicial proceedings. Evidence shall be handled carefully to prevent contamination, loss or unauthorised access.

All evidence shall be properly labelled, sealed where appropriate, documented and transferred in accordance with established chain-of-custody procedures and applicable legal requirements.

Examples of Evidence to be Preserved

  • Clothing and personal belongings.
  • Blood, urine and other biological samples.
  • Toxicology specimens.
  • Bullets, pellets or foreign bodies removed during treatment.
  • Medical photographs where legally permissible and clinically appropriate.
  • Radiographs, CT, MRI and other diagnostic images.
  • Medical records and treatment notes.
  • Any other material relevant to investigation.

PATIENT RIGHTS & CONSENT

Patient Rights & Consent

Patients involved in Medico-Legal Cases shall be treated with dignity, compassion, fairness and without discrimination. The Hospital shall respect patient rights while fulfilling mandatory legal reporting obligations under applicable law.

Wherever legally required and clinically appropriate, informed consent shall be obtained before examination, investigations, procedures or photography. Where the law permits or mandates examination or reporting without consent, the Hospital shall comply strictly with the applicable legal provisions.

Respect patient dignity and privacy.
Obtain informed consent where legally required.
Explain procedures in a language the patient understands whenever practicable.
Protect the patient's confidentiality while complying with legal obligations.
Provide emergency treatment without discrimination.
Respect applicable legal rights of minors and vulnerable persons.

CONFIDENTIALITY

Confidentiality of Medico-Legal Records

Medico-Legal records shall be treated as confidential medical records and shall be protected from unauthorised disclosure. Access shall be limited to authorised healthcare professionals, Hospital Management and lawful authorities who are entitled to receive such information.

Information relating to Medico-Legal Cases shall not be disclosed to unauthorised individuals, media representatives or third parties except where disclosure is authorised by the patient, required by law or directed by a competent authority.

Confidential Handling

Confidentiality shall be maintained throughout the investigation, treatment, documentation, storage and retention of Medico-Legal records while complying with lawful reporting obligations.

STAFF RESPONSIBILITIES

Responsibilities of Hospital Personnel

Every Registered Medical Practitioner, nurse, pharmacist, laboratory personnel, Medical Records Department employee, security personnel and other authorised Hospital staff involved in Medico-Legal Cases shall comply with this Policy and all applicable legal requirements.

Staff Responsibilities

  • Identify potential Medico-Legal Cases promptly.
  • Provide emergency treatment without delay.
  • Maintain accurate and complete documentation.
  • Preserve medico-legal evidence appropriately.
  • Notify police or competent authorities where legally required.
  • Maintain confidentiality of patient information.
  • Cooperate with lawful investigations.
  • Participate in periodic medico-legal training programmes.

Professional Responsibility

Proper handling of Medico-Legal Cases protects patients, healthcare professionals and the Hospital while supporting the administration of justice and compliance with Indian law.

HOSPITAL RESPONSIBILITIES

Responsibilities of the Hospital

Sri Lakshmi Multi Speciality Hospital shall establish and maintain appropriate systems, policies, infrastructure and trained personnel for the proper identification, management, documentation and reporting of Medico-Legal Cases (MLCs). Hospital Management shall ensure that all departments comply with applicable Indian laws, professional ethics and recognised healthcare standards.

The Hospital shall cooperate with lawful investigations while safeguarding patient dignity, confidentiality and professional independence.

Hospital Commitments

  • Maintain a Medico-Legal Case (MLC) Register.
  • Ensure timely police or statutory notification where legally required.
  • Provide secure storage of medico-legal records and evidence.
  • Support staff through regular medico-legal education and training.

LEGAL HOLD & RECORD RETENTION

Legal Hold & Retention of MLC Records

All Medico-Legal records shall be preserved in accordance with applicable Indian laws, Hospital policies and recognised professional standards. Where litigation, criminal investigation, judicial proceedings, police inquiry, insurance claim or any other legal proceeding is pending or reasonably anticipated, the relevant records shall immediately be placed under a Legal Hold.

Records under Legal Hold shall not be destroyed, altered, archived for disposal or otherwise removed until all legal proceedings have concluded and written authorisation for release has been obtained from the competent Hospital authority.

"Legal Hold overrides the normal record retention period. Preservation of Medico-Legal records is essential for judicial proceedings and regulatory compliance."

CONTINUOUS IMPROVEMENT

Continuous Improvement

Sri Lakshmi Multi Speciality Hospital shall periodically review Medico-Legal Case management practices, documentation standards, staff competency, audit findings and changes in applicable laws to strengthen legal compliance and patient safety.

Lessons learned from medico-legal incidents, internal audits, judicial observations, patient feedback and regulatory inspections shall be incorporated into policy revisions, staff education and operational improvements.

Quality Improvement

Continuous evaluation of Medico-Legal procedures strengthens patient safety, professional accountability, legal preparedness and compliance with NABH accreditation standards.

POLICY REVIEW

Policy Review

This Medico-Legal Case (MLC) Policy shall be reviewed periodically by Hospital Management to ensure continued compliance with applicable Indian laws, judicial developments, National Medical Commission Regulations, government guidelines and NABH accreditation standards.
